Our terms and conditions apply to all transactions on the Trademark Shop Limited website. Please read through these carefully before placing your order as if you choose to use this website and place an order you automatically agree to our Terms and Conditions.

YOU AGREE THAT BY USING THIS SERVICE YOU ARE AT LEAST 18 YEARS OF AGE AND YOU ARE LEGALLY ABLE TO ENTER INTO CONTRACT.

If you object to any of the Terms and Conditions set out in this agreement, you should not use this website or the on line service provided here.

Trademark Shop Limited may change these terms and conditions from time to time without notice and your use of the Website will be deemed as acceptance of this agreement. We advise you to check this page regularly so you are always up to date on any changes.

PRICING/ FEES

We offer two types of services; Fixed Fee Services and Consultancy Services.

In all cases, it is our policy to issue quotations in writing. The price you pay is the price quoted to you by way of email prior to engaging our office. While we try and ensure that all prices on our website are accurate, if we discover an error in the price of services you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you within 7 days from the date of your order we will treat the order as cancelled. If you cancel and have already paid for the service, you will receive a full refund.

(i) Fixed Fee Services

Our Fixed Fee Services are a low cost alternative designed to provide a reliable service at great value for money.
You benefit from our experience and your application is given the best chance of success.

To benefit from this service you only need to provide us with:

1. The trademark you wish to register (either words or logo);
2. A brief description of the goods and services you provide and wish to be protected;
3. The name, address and contact details of the owner of the trademark;
4. The relevant fees.

Unfortunately, we cannot be held responsible for unsuccessful applications. In addition, we cannot be responsible for any errors in the information you supply.
If you later request changes to the information you have submitted this may incur additional cost and may require a new application at additional cost.

Our Fixed Fees are listed on our website and may vary from time to time and only covers our professional fee in relation to the drafting and submission of a single trademark application. These fees do not cover any additional work arising subsequent to the application being submitted, whether this is by way of an official query or third party opposition to any such trademark application.

The fixed fees include outlays as follows (valid as of December 2010):-

-For an Irish application, the Patents Office's basic fees will amount to €247.00.
-For a Community Trademark the OHIM’s basic fees will amount to €900.00.

In the OHIM a fee of €150.00 will arise per additional class above three and in the Irish Patent Office additional fees of €70.00 will arise per additional class above one.
These additional costs are not included in the Fixed Costs fee.

(ii) Consultancy/ Other Services

We understand that some customers may want more than our basic service and we provide many consultancy services at a separate charge.

Depending on your request, we will endeavor to provide you with a fixed estimate in writing for all other services. We charge for our time and calculate our fees at an hourly rate of €250.00. Where we have agreed to act for you and you decide not to proceed for any reason, you agree to discharge our full fees plus outlays incurred.

In all circumstances where you seek to engage us to advise you or act on your behalf (whether by way of consultation in our office or otherwise), there will be a minimum fee of €150.00. If any information comes to our attention which was not known at the time of providing the quotation, we must reserve the right to revise our fee.
Any funds received will be held as a retainer and paid towards your final invoice. Our fee becomes due when work has been done on your behalf.

AVAILABILITY

All orders are accepted subject to the availability of the service.

From time to time our services change and if the service you have chosen becomes unavailable after you have submitted your order, or we are unable to supply the service, we will inform you of this as soon as possible. We will try and offer you a similar service if you are in agreement. If not, a full refund will be given where you have already paid for the service.

PAYMENT

We accept Visa and MasterCard. Unfortunately at this time, we do not accept American Express cards. All your personal information, credit card details, addresses and phone number are encrypted via the secure purchase area of our site. We use industry standard SSl technology to ensure all sensitive information is fully encrypted.

We can also accept payment by way of online bank transfer or cheque or bankers draft made payable to Trademark Shop Limited. If you wish to pay by cheque, we must allow 5 working days for same to clear in our account.

RETURNS AND REFUND POLICY

We make every effort to describe our services in great detail. However, if you feel that after you purchase one of our services it is not suitable, you will receive a refund if requested by you in writing within 7 days of the date of your payment. After this time no refunds will be permitted. A refund will be issued to the credit card that was used to place the order

PROBLEMS & COMPLAINTS

In the unlikely event that you have a complaint these should be directed in writing to the Director, Trademark Shop Limited, 313 Capel Building, Dublin 7.

Where we are at fault and you suffer loss as a direct result of using our services our liability is expressly limited to the value of the payment we have received from you unless expressly agreed with you in writing.

We expressly exclude liability towards any third parties.

Where you are not a consumer, any disputes will be governed by Irish law and the Irish courts have exclusive jurisdiction.
